You agree to accept the following Terms and Conditions when you activate service. Your use of any EZlink service indicates your acknowledgment and agreement to these Terms and Conditions. You may refund your EZlink card if you do not find these terms acceptable. You may not obtain a refund, change or transfer your service once your card is loaded (or PIN redeemed). The following information is accurate as of the date below. The current Terms and Conditions as noted on the website govern in the event of any conflicts. You can read a current version on our website, www.EZlinknow.com or request a copy or hear the terms by calling Customer Service at (877) 327-6691. We may change these Terms and Conditions at any time and the modified terms will be effective on airtime cards you purchase subsequent to their publication.
Charges and Features:
You may choose an EZlink plan provided below. You will be charged for incoming and outgoing voice calls (including calls to Customer Service and to check your balances) unless otherwise indicated plus the charge of any additional service. International Long Distance is generally not available. You are responsible for any taxes or surcharges in addition to the service charges. The following is a list of EZlink features and charges:

*Off-peak Inbound and Outbound calls on EZlink XTRA exceeding available Night & Weekend minutes are charged at the Peak Rate per min.
*Peak Inbound and Outbound calls on EZlink PLUS and EZlink MAX are rounded up to the next minute and are charged one additional minute per call.
*Off-peak Outbound Party/Chat Line calls on EZlink PLUS are charged one Minute per minute.
*Peak and Off-peak Outbound calls on EZlink NEXT are rounded up to the next minute and are charged for one additional minute per call.
Minimum Balance:
You must maintain a minimum balance to avoid service suspension. On plans that require Access Days, you must maintain a minimum balance and a minimum of one Access Day to avoid service suspension. Calls or average usage that will reduce or are likely to reduce your balance below the required minimum will result in suspension of your service. Upon loading another EZlink product that brings your account balance above the minimum balance your service will be restored with no extra fees and any balance will carryover. On plans that require Access Days, loading another EZlink product that brings your account balance above the minimum balance and provides Access Days, your service will be restored with no extra fees and any balance will carryover. Minutes that are not used within 120 days from initial load shall be forfeited. If your account is suspended for longer than your Maximum Suspended Days, your service will be disconnected. Upon disconnection, your balance and phone number will be forfeited.
Restrictions & Limitations:
EZlink PLUS Nights & Weekends Cards: Night & Weekend calling is available from 9 p.m. – 7 a.m. Monday through Thursday, and from 9 p.m. Friday to 7 a.m. Monday local time for local calls within the Home Calling Area only. Hours other than Nights & Weekends are considered the Peak Calling Period. Unattended calls, “Party/Chat line” calls, Three-Way Calls, Call Waiting, Off-Network Roaming and calls involving features listed above are not included in Nights & Weekends and are chargeable.
Eligibility for EZlink PLUS UNLIMITED Nights & Weekends Program:
Purchase of an EZlink PLUS Nights & Weekends card will entitle the user to unlimited night and weekend minutes subject to the above restrictions. However, excessive use of a prior Nights & Weekends card, defined as use of more than 2,000 Night & Weekend minutes over a two week period, will make you ineligible to purchase additional EZlink PLUS Nights & Weekends Cards in which event DBS reserves the right to offer you different calling plans.
Call Restrictions: Calls to certain telephone numbers or regions may be restricted (including calls to 500, 700, 900 or 976 numbers). Three-Way calling, Caller ID, Text (SMS) Messaging, operator assisted calls, and other features may not be available on your handset or in your calling area.
Handset Restrictions: Your handset (including the subscriber identity module or “SIM”) will be restricted to EZlink services enabled by DBS Communications, Inc. (DBS), and cannot be activated on any other wireless service for two years from the date of purchase. You agree not to tamper with or alter your handset or its software, your EZlink SIM, or to enter unauthorized PIN numbers, or engage in any other unauthorized or illegal use.
Service Cancellation, Limitation of Liability and Other Terms:
Your service, and account balance, may be refused, suspended or cancelled with or without notice for reasons of illegal activities such as fraud or theft of services, or if we in our sole discretion believe that you have violated these Terms and Conditions or our policies, or cannot pay any charges for service, or for prohibited uses (including without limitation excessively long or unattended calls or series of such calls, or by calling destinations not explicitly allowed by EZlink, data calls, calls using a computer or party-line type calls during Night and Weekend hours, using equipment that may interfere with our network or service to customers, or failing to use an authorized SIM) or for utilizing the service for other than for its intended purpose. DBS also reserves the right to offer you a different calling plan or not to authorize the purchase of additional cards if you are no longer eligible for our services and/or plans. Cards which are not loaded within six (6) months of purchase will be forfeited and DBS will not be liable for any services. Service rates, minute denominations, additional fees and other terms are subject to change without notice at our sole discretion. The Terms and Conditions of other EZlink products may apply or supersede these Terms and Conditions. Other restrictions apply. The coverage map is an approximation of coverage, and actual wireless coverage may not be available in all areas within the coverage map. Your wireless services may be affected by network outages and weak signal conditions, and will not be available in all locations or at all times. DBS shall not provide any credit for dropped or interrupted calls. DBS may use any carrier to provide services and may change any of its service providers without notice.
DISCLAIMER OF WARRANTY: DBS DOES NOT WARRANTY SERVICE BY THE CARRIER AND SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES CAUSED BY SERVICE OUTAGES ON THE CARRIER’S SYSTEM. DBS SHALL NOT BE LIABLE FOR ANY CLAIMS RELATING TO ANY SERVICES NOT PROVIDED BY DBS AND PRODUCTS NOT MANUFACTURED BY DBS. DBS is not responsible for lost or stolen cards, or unauthorized use of services described on the card, or for any interruption of telecommunications services. If your phone is lost or stolen, please visit the nearest retail location to have your phone suspended temporarily. DBS LIMITS ITS LIABILITY TO THE FACE VALUE OF THIS CARD IN THE EVENT YOU SUFFER ANY LOSS OR DAMAGES AS A RESULT OF ANY ACT OR OMISSION BY DBS OR AS A RESULT OF THE BREACH OF THESE TERMS AND CONDITIONS.
We may contact you on your EZlink wireless phone, by e-mail, or by telemarketing or direct mail to notify you when your balance is low and to inform you of product and promotional offers of EZlink. EZlink is provided only by DBS and its authorized agents.
Resolution of Disputes: All disputes between you and DBS, including issues of arbitrability, shall be settled by binding arbitration under the rules of the American Arbitration Association including its Wireless Industry Arbitration and its Supplementary Arbitration Rules. All claims shall be arbitrated individually and there shall be no consolidation or class treatment of any claim unless previously agreed to by DBS. Both you and DBS waive any trial by jury.
Privacy Policy:
DBS Communications, Inc. (DBS) has created this policy statement (the "Policy") to explain our privacy practices and policies for EZlink services.
We will not sell or disclose your personal information to unaffiliated third parties for marketing purposes without your consent except as otherwise provided in this Policy. When you sign up or use any of our products or services, we may use information about who you are, where and when you browse the Web, where your wireless device is located, and how you use our network to provide you better service and enrich your user experience.
DBS may make available shorter or machine readable versions of this Privacy Policy. These additional policies are intended only as summaries of this complete Privacy Policy. This Policy applies to customers who purchase and use our services and products in the United States. Collection, use, disclosure, and protection of personal information may be subject to different regulation outside the United States.
DBS may revise and update this Policy as it deems appropriate, including, for example, if our practices change or if changes in the law so require.
